Terms

The below terms and conditions differ significantly from our other offers, so please read them in full before submitting a listing request or bidding on a broking list case. Listing Requests: If you would like to advertise wines on our broking list please contact our Private Client team for a current UK market valuation. This will form the broking list sale price and must be agreed for each wine, in writing, in advance of any listing. If you wish to list wines above or below our current UK market valuation this must be via specific written agreement with our Private Client team. We reserve the right to refuse or rescind listings at any point.

Listing Requirements: The following requirements must be met for listings to be accepted:

  • All wines must be in original undamaged cases, unless otherwise agreed. It is the responsibility of the seller to check and confirm the correct case size and format. Please notify us immediately of any error. Any liabilities relating to inaccurate reporting of case sizing and/or format will be due to the seller.
  • You must be the sole owner of any wines advertised and capable of producing documentation proving ownership and good provenance of the wines in question.
  • Unless otherwise agreed in writing, all wines must meet a minimum list price of £500 per dozen bottles in bond (or £250 per six bottles in bond).
  • All wines must be in good condition - specifically with label condition and level appropriate to the age of the wine. In bond stock is assumed to be of good condition. Duty paid stock must be delivered, at the cost of the seller, to our duty paid warehouse (Battersea, London) for inspection. We offer a collection service for duty paid stock charged at the same rate as deliveries for orders under £100 (please see our standard delivery terms for more details). There is no collection cost for wines held in duty paid Elephant Storage accounts.
  • We reserve the right to exclude stock upon inspection but our inspection does not amount to a guarantee of good condition and wines are all sold caveat emptor. Any excluded stock will be returned to the seller at their cost, or we may contact the seller to discuss advertising wines on our broking list at a discount to current market value.
  • Wines lying in an Elephant Storage Limited ('ESL') account at Octavian, Corsham, can be listed immediately with no additional delivery or transfer costs due to the seller. Wines lying outside an ESL account are admissible to the broking list but please note that, should a sale occur, all costs associated with delivery to ESL or transfer to the nominated in bond account of the buyer will be due to the seller.

  • Listing Guarantees: Wines will remain advertised on the broking list until a sale is achieved or we receive written notice from the seller to withdraw their wines. We make no guarantee of sale and we reserve the right to suspend a listing at any point due to a change in current UK market value. In this instance, wines will be removed from the broking list immediately and our Private Client team will contact you to confirm a new listing price in writing. If agreed, we will restore the listing at the revised price.

    Listing Fees & Payment Terms: Unless otherwise agreed in writing, we charge 10% of the agreed list price as a brokerage fee. Once a sale is agreed, we will issue the seller with a Purchase Order for the list price, less our brokerage fee, any delivery fees, or any other relevant charges. Once this Purchase Order is issued, a sale is agreed and wines cannot be withdrawn from the broking list. We will credit your Lea & Sandeman account or make a sterling payment to a nominated UK bank account within 30 days of the Purchase Order date of issue. Please note that Elephant Storage charges will still apply up to the point a Purchase Order is issued and will be invoiced separately by Elephant Storage in the usual way.

    Purchasing & Pricing: Unless otherwise stated here, our standard terms and conditions of sale apply. All wines on the broking list are offered by the case size stated, subject to availability and final confirmation. All wines, including those sold under bond or in undamaged original cases, are offered caveat emptor with no returns. Broking list pricing is all in bond, by the case size stated and only complete cases are available for sale. If you would like wines duty paid, please note that duty and VAT will apply at the prevailing rate, currently £26.78 per dozen and 20%.

    Purchase Payment Terms: Payment is required immediately on sight of invoice, by cash, cheque, debit card or direct bank transfer. We cannot accept credit cards for broking purchases. A sale is not confirmed, and delivery will not take place, until all funds relating to the invoice have cleared to our account.

    Delivery - Timing: Please specify with your order where you would like the wines shipped. Delivery times will vary depending on your instruction but please allow up to three weeks from the date of payment (cleared funds to our account) for in bond and duty paid delivery.

    Delivery - Fees:
  • For duty paid orders, our standard duty paid delivery terms apply. Please note that extra fees apply for express and nominated day delivery, or shipment to addresses outside our normal operating zones. For international delivery, please ask for a quote at the time of ordering and note that UK duty & VAT may still apply. In the case of failed delivery additional charges may apply depending on the circumstances.
  • All in bond transfers to third party bonds (i.e. not Elephant Storage) are subject to an under bond administration & handling fee which is charged at cost based on volume and destination.
